St. Jude Children's Research Hospital (St. Jude) has its very own garden. St. Jude, Children's GMP LLC, and ALSAC employees may support the work of the Food Services department and St. Jude Garden staff by serving as a garden volunteer.

Participation as a garden volunteer may involve standing and walking for extended periods. Volunteers will also engage in repetitive kneeling, sitting, bending and lifting. Performing these tasks carries with it inherent risks of injuries that cannot be eliminated regardless of the degree of care taken. Such risks vary in range from minor injuries (insect bites/stings, sunburn, cuts, bruises, muscle soreness and sprains) to major injuries (back injuries, broken bones, fainting, frostbite or heat stroke).

St. Jude, Children's GMP LLC and ALSAC employees who wish to participate in the St. Jude Garden Volunteer Program:
• Must obtain approval from their supervisor before serving as a volunteer in the St. Jude Garden
• Will not be paid for time spent or tasks performed while serving as a St. Jude Garden volunteer
• Cannot perform St. Jude job duties while serving as a St. Jude Garden volunteer
• Cannot be non-exempt employees assigned to the Food Services department or St. Jude Garden
• Cannot be employed in any non-exempt position at St. Jude that requires them to perform the same tasks that are assigned to St. Jude Garden volunteers

As a participant in the St. Jude Garden Volunteer Program, I understand and agree to the following:

Preparation and Inspection. I understand it is my responsibility to protect myself from the elements (i.e., the outdoor environment and hot/cold temperatures), including providing my own sunscreen. I also understand the importance of drinking fluids to stay hydrated while performing tasks in the garden. I will inspect my assigned work area and any assigned equipment/tools before beginning each volunteer assignment and alert a member of the St. Jude Garden staff if I have safety-related concerns.

Assumption of the Risks. I freely choose to participate in the St. Jude Garden Volunteer Program, and understand that I am doing so at my own risk. By participating in the St. Jude Garden Volunteer Program, I agree to take full responsibility for any risks, injuries or damages, known and unknown, may result from my exposure to the elements (heat, cold, weather conditions, etc.); contact with plants, crops and insects; and use of any garden tools/equipment. In consideration for my participation in the St. Jude Garden Volunteer Program, I agree, for me and for my family (including my heirs and personal representatives), to release and forever give up any right to make any claim whatsoever, even in the case of personal injury or wrongful death. I promise not to sue St. Jude, ALSAC, their owners, officers, directors, employees, the volunteers, or anyone else for any claim related to my participation in the St. Jude Garden Volunteer Program, including but not limited to, all legal responsibilities, claims, actions, any injury, damages, costs, or expenses whatsoever.

Confidentiality: I understand that as a St. Jude garden volunteer, I am subject to the same confidentiality requirements as when I am acting in my capacity as a St. Jude, Children's GMP LLC or ALSAC employee. This means I cannot share information I learn while working in my capacity as a St. Jude, Children's GMP LLC or ALSAC employee with other St. Jude garden volunteers unless required to do so by law, St. Jude policy, or to perform my volunteer assignment. This also means I cannot share information I learn while serving in my capacity as a St. Jude garden volunteer with other St. Jude, Children's GMP LLC or ALSAC employees unless required to do so to by law, St. Jude policy, or to perform my duties as a St. Jude, Children's GMP LLC, or ALSAC employee.

Acknowledgement of Understanding. I understand that the terms of this agreement are intended to be as broad and inclusive as is permitted by the laws of the State of Tennessee and that if any portion is determined to be invalid, the remainder of the agreement shall nevertheless continue in full force and effect. I have read this agreement, fully understand its terms and acknowledge that my initials below are evidence of my understanding. I am 18 years of age or older and am accepting and acknowledging this agreement freely and voluntarily. I intend my acknowledgement and acceptance to be a complete and unconditional release of all liability to the greatest extent allowed by law.
