COVID 19

Given the recent global events of the COVID-19 pandemic many of you have been wondering and waiting to see what 2020 has in store for Sacramento Pride's Celebration and season of events. We are closely monitoring the situation and complying with all city, county, state and federal guidelines. For the time being we are more than 3 months away from our scheduled celebration and we are still committed to putting on a safe and joyous Pride event for Sacramento so we are moving forward as planned!

Model Release Form

Thank you agreeing to participate in a photo/video shoot for the Sacramento LGBT Community Center (the Center). Participation at this event and/or sharing your story with the Center through quotation, photos and video that demonstrate the impact and benefit of the Center’s programs on the lives of real people is appreciated. Quotations, photos, and video from this shoot will be used in marketing materials including, but not limited to, the Center’s Web site, letters, posters, flyers, tickets, e-mails, social media postings, videos, advertisements and other printed and electronic materials.


Affirmation

In consideration of my engagement as a model, upon the terms herewith stated, I hereby give to the Sacramento LGBT Community Center (the Center), its legal representatives and those acting with its authority and permission:


a) The unrestricted right and permission to copyright and use, re-use, publish and republish photos and video of me or in which I may be included intact or in part without restriction as to changes or transformations made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose whatsoever.

b) Permit the use of any printed material and video in connection therewith.

c) Hereby relinquish any right that I may have to examine or approve the completed product or products or the advertising copy, video or printed matter that may be used in conjunction therewith or the use to which it may be applied.

d) Hereby release, discharge and agree to save harmless Center designated photographers and videographers, the Center, its legal representatives and all persons functioning under its permission or authority, from any liability by virtue of any blurring, distortion, alteration, optical illusion or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of said picture/video or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.


Authorization

I affirm that I am over the age of 18 and have the right to contract in my own name. I have read the above authorization, release and agreement, prior to its execution; I fully understand the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns.

Liability Waiver


RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (“AGREEMENT”)

IN CONSIDERATION of being permitted to participate in Sacramento Pride (“Activity”) as a volunteer I, for myself, my personal representatives, assigns, heirs, and next of kin:

1. ACKNOWLEDGE, agree, and represent that I understand the nature of Pride volunteer activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further acknowledge that the Activity will be conducted over public roads, sidewalks, and facilities open to the public during the Activity and upon which the hazards of traveling are to be expected. I further agree and warrant that if, at any time, I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.

2. FULLY UNDERSTAND that: (a) PRIDE VOLUNTEER ACTIVITIES MAY INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my own actions, or inactions, the actions or inactions of others participating in the Activity, or the condition in which the Activity takes place; (c) I AM EXPECTED TO COMPLY WITH ALL STATE, LOCAL, AND MUNICIPAL LAWS in the course of my conduct in the Activity, including commands of law enforcement personnel, and will be SOLELY RESPONSIBLE FOR ANY LEGAL ACTION (INCLUDING ARREST) brought against me for my non-compliance with Colorado law and/or non-compliance with law enforcement commands; (d) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation in the Activity.

3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE THE LGBT COMMUNITY CENTER OF SACRAMENTO AND SACRAMENTO PRIDE, their administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, and advertisers (each considered one of the “RELEASEES” herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.



FOR YOUTH VOLUNTEERS: IF THE PARTICIPANT IS UNDER 18, THE PARENT (OR LEGAL GUARDIAN) MUST SIGN. I am the parent of legal guardian of the above participant and he/she has my permission to participate in Sacramento Pride. I have read and agree to the provisions stated bove for myself and for the participant. Further, I understand and agree that the sponsors and organizers of the Event are not responsible for supervision of minor participants and

that if I allow the above minor to participate without my supervision, I assume all the risks from such participation.



ETHICS AGREEMENT

In order to protect the best interest of clients and volunteers and as a condition of being a paid staff person or volunteer of the Sacramento LGBT Center and its programs, I agree to adhere to the organization’s ethical standards. I agree to speak to my supervisor or the Human Resources department in the event that any of the above ethical standards remain unclear or when an ethical situation arises that needs clarification. I agree to adhere to the ethical standards stated above and to use good judgment to follow the “spirit” of the policy where specific situations are not fully stipulated.


ALCOHOL & DRUG USE POLICY

I hereby agree to adhere to the Sacramento LGBT Center policy regarding Alcohol and Drug Use. It is forbidden for me to bring intoxicating liqueurs, narcotic drugs or chemicals into the Sacramento LGBT Center or onto the premises. Likewise, it is forbidden for me to be on duty while under the influence of or possessing alcohol, drugs or intoxicants of any type.


FEDERAL DRUG FREE WORKPLACE ACT

All employees and volunteers are required by federal law to abide by the Federal Drug Free Workplace Act Policy as a condition of their employment, paid or voluntary, at the Sacramento LGBT Center. In addition, all employees and volunteers are required to report to the Executive Director/Board of Directors any criminal drug statute conviction for conduct in the workplace within 5 days of the conviction.


STATEMENT OF CONFIDENTIALITY

In the interest of fostering confidence in all clients/service recipients regarding the security and privacy of all information contained in the records of any and all departments of the Sacramento LGBT Center, I, as a paid staff person or volunteer of the Sacramento LGBT Center agree to adhere to the agency's guidelines regarding client confidentiality.


RELATIONSHIPS IN THE WORKPLACE POLICIES

I hereby agree to adhere to all Relationships in the Workplace Policies and to use good judgment to follow the "spirit" of the policy where specific situations are not fully stipulated. As this policy is not all encompassing, if I have any issue or question, I agree to bring them to the attention of my supervisor or the Human Resources department.


CONFLICT OF INTEREST/UNLAWFUL SOLICITATION

By virtue of being an employee of an outside agency, corporation or business concern, no paid or volunteer staff member of the Sacramento LGBT Center or economic dependent of staff member shall exert influence or have any direct or indirect financial interests in the awarding of any agreement or competing agreements or refer the Sacramento LGBT Center clients to said outside agency, corporation or business concern.


No paid or volunteer staff member of the Sacramento LGBT Center shall act as a runner or capper for attorneys in violation of all provisions of Article 9, Chapter 4, Division 3, Section 6150 of the Business and Professions Code of the State of California.


PHOTO RELEASE POLICY

By signing this agreement, I grant full permission for the Center, its nonprofit partner agencies, and it’s officers and directors, employees, agents, and volunteers (“Releases”), to use photographs, video, and audio of myself, and quotations from myself, in accounts, promotions, and publications of the Center and these activities, and I hereby waive my right of publicity in connection with such uses.


SEXUAL HARASSMENT POLICY

Sexual harassment is defined as unwelcome sexual advances, requests for sexual favors, and other verbal, or physical conduct of a sexual nature when, a) submission to such conduct is made either explicitly or implicitly a term or condition of an individual’s employment or volunteer or internship opportunity, b) submission to or rejection of such conduct by an individual is used as the basis for employment, volunteer or internship decisions affecting such individual, or c) such conduct has the purpose or effect of unreasonably interfering with an individual’s performance or creating an intimidating, hostile, or offensive working environment.


Sexual harassment includes:

• Verbal harassment, such as epithets, derogatory comments or slurs.

• Physical harassment, such as assault, impeding or blocking movement or any physical interference of another’s normal work or movement when directed at an individual.

• Visual forms of harassment, such as displaying derogatory posters, cartoons or drawings that are offensive.

• Requests for sexual favors or making unwanted sexual advances.


The Center has a zero-tolerance policy for discrimination of any kind by staff, supervisors, colleagues, clients, volunteers, interns, vendors, or contractors. Complaints are to be communicated to a supervisor, member of management, Volunteer Resources or Human Resources. Complaints will be followed by a fair, complete and timely investigation. Confidentiality will be maintained throughout the investigatory process to the extent consistent with adequate investigation and appropriate corrective action if any wrongdoing is detected. There is no guarantee of complete confidentiality, but the Center will strive to maintain confidentiality on a business need-to-know basis during the investigation.


Retaliation against any individual for reporting harassment or discrimination or for participating in an investigation of a claim of harassment or discrimination is a serious violation of this policy, and like harassment or discrimination itself, will be subject to disciplinary action, up to and including termination. Acts of retaliation should be reported immediately and will promptly be investigated and addressed.


This is to acknowledge that I have received and read copies of the Sacramento LGBT Center's policies on ethics confidentiality, relationships in the workplace, alcohol & drug use, conflicts of interest and unlawful solicitation, sexual Harassment Policy, which are applicable to all employees and volunteers. I understand the policies and have been given an opportunity to discuss any questions I have at this time. I understand that I may discuss future questions with my manager, supervisor or with Human Resources. I understand and have read the newly revised packet of policies and will agree to adhere to all policies and guidelines attached.
