Waiver of Liability

The undersigned certifies that he or she is at least 21 years of age and wishes to volunteer at ALIVE Rescue (the “Organization”). The undersigned attests and acknowledges that (a) he or she has freely, voluntarily and without duress chosen to volunteer, and (b) that he or she is aware that the Organization takes in, houses, and places stray, abused, and or abandoned animals, which may not be fully domesticated or friendly to people and that such animals can be risky or dangerous.


The undersigned accepts and assumes the risk of any and all injuries from such animals that are related to coming into contact with said animals.


The undersigned releases, discharges, and absolves the Organization and its Shelter, Shelter Supervisor, directors, officers, administrators, agents, assigns, volunteers, employees, trustees or any other affiliated person or entity from all liability for any and all claims, demands, causes of action or suits, including without limitation any injuries to person and property, including, without limitation, to any animals owned or supervised, for any losses that he or she may suffer, resulting from his or her voluntarily choosing to volunteer at the Organization.


The undersigned further agrees that if, despite this Waiver of Liability he or she or anyone on his or her behalf makes a claim against the Organization prohibited by this Waiver, the undersigned will indemnify, save and hold harmless the Organization from any damages, losses and expenses, including, but not limited to, legal fees, court costs, and litigation expenses.


The undersigned agrees that any injury, damage, or loss, of any kind whatsoever, to any person or animal caused by dogs and/or cats is solely his or her responsibility and he or she will indemnify, save, and hold harmless the Organization and its Shelter, Shelter Supervisor, directors, officers, administrators, agents, assigns, volunteers, employees, trustees or any other affiliated person or entity from any such damages, losses and expenses, including, but not limited to, legal fees, court costs, and litigation expenses. The undersigned also agrees that the Organization does not assume any responsibility for or obligation to provide financial assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.


The undersigned acknowledges that the Organization does not carry or maintain health, medical, or disability insurance coverage for any Volunteer.


The undersigned releases and discharges the Organization from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with his or her activities at the Organization.


The undersigned acknowledges and agrees that he or she: (a) fully understands the meaning of this Waiver and recognizes his or her right to seek the advice of an attorney before signing it; (b) has signed it freely and without any inducement or assurance of any nature; (c) intends it to be a complete, unconditional release of liability to the greatest extent allowed by law; and (d) agrees that if any portion of this Waiver is held to be invalid the balance notwithstanding shall continue in full force and effect. The acceptance of this Waiver shall not operate as an admission of liability on the part of anyone, nor as a waiver or bar with respect to any claim that the Organization may have against the undersigned.


This Waiver is binding on undersigned’s heirs, executors, assigns, and administrators. The undersigned attests that he or she is aware of the risks of volunteering at the Organization and its Shelter and hereby assumes all risks, whether foreseen and unforeseen, known and unknown.


In entering into this Waiver, the undersigned acknowledges and agrees that he or she has not relied upon any statement or representation from the Organization and its Shelter, Shelter Supervisor, directors, officers,

administrators, agents and assigns, volunteers, employees, trustees or any other affiliated person or entity that the animals will not be harmful.


The undersigned hereby declares that I have read and understood and voluntarily accept the terms and conditions of this Waiver.
